Contract Terms And Conditions

CHS Plumbing will construct for Owner the improvements identified in the associated invoice or proposal (“Work”) for the price indicated within the invoice or proposal.

PAYMENT – Payment is due on the day of service, unless otherwise noted within the proposal or invoice. Payments not received in full on the day of service are subject to a late fee. Unpaid invoices after 10 days are subject to collections which include, but are not limited to, Theft of Services filed at the Local Police Department, Civil Court and reporting to all national collection agencies. Upon execution of the proposal, the Owner will provide payment as provided in the proposal. The Owner shall pay all invoices within 10 days from the date of the invoice. An interest charge of 1.5% per day will be assessed to all invoices 10 days or older from the date of service. All work performed by CHS Plumbing shall be completed in a craftsman like quality manner and will comply with all local and state building codes.

RETURNED CHECK POLICY – If your check is returned for non-sufficient funds, you expressly authorize your account to be electronically debited or bank drafted for the amount of the check plus any applicable fees. The use of a check for payment is your acknowledgment and acceptance of this policy and its terms and conditions.

CHANGES TO THE AUTHORIZED WORK – If at any time while the work is being performed and the price may need to change due to unforeseen circumstances, or the Owner has chosen more options, then, CHS Plumbing will give the Owner an upfront price showing the difference. Before the work can proceed, the Owner will give authorization by way of a signature.

OWNER / TENANT SITUATION – CHS Plumbing will only schedule an appointment with the property Owner. The Owner will need to make contact with the tenant for the scheduling of all necessary repairs. CHS Plumbing will not be responsible in doing so. CHS Plumbing will provide to the Owner all estimates for proposed work. Approval will be given to CHS Plumbing by the Owner before any such repairs will be made. If the Owner is out of state, as is the case with a majority of our customer’s, then, CHS Plumbing will get a verbal authorization and duly note the situation on the invoice. The Owner is responsible for invoice payment.

SCHEDULING – A credit card will be required to be put on file when making a scheduled appointment. This card will not be charged until the work has been completed and the Owner has signed off on the invoice. CHS Plumbing will charge a service fee of $45.00 if we show up to the residence and are unable to reach the Owner. The Owner agrees to these terms and understands why such a fee will be charged. Payment type can be changed to credit card, cash, check, or financing once CHS Plumbing has completed the work and is processing the payment.

FINANCING – CHS Plumbing offers an outsourced financing institution with different terms and rates. The Owner understands that there will be an additional fee, depending on what terms and rates are qualified for. CHS Plumbing is not a financial institution and will not set up a payment schedule for completed work. The Owner must qualify for the financing before any work will be performed, or have other means of payment. CHS Plumbing will be paid in full at the time of service.

DAMAGES – CHS Plumbing will not be held liable for any tampering or altering of products that we have installed. Pictures of all before and after work will be taken and kept record of. In the event that CHS Plumbing finds personal property damaged, then, it will be brought to the attention of the Owner and Service Division Manager. If the damage is caused by CHS Plumbing, then, the Owner will be reimbursed for such damages. CHS Plumbing is of the highest standards and will most certainly correct the situation with our customer.

TERMINATION OF PROPOSAL – CHS Plumbing reserves the right to cancel a proposal at any time. In the event that an Owner becomes belligerent and or verbally abusive, then, CHS Plumbing will cancel the proposed work. The Owner agrees to treat CHS Plumbing in a civil and respectful manner. CHS Plumbing will never pressure an Owner into a contract. If CHS Plumbing has incurred the cost of a special order item for the job and the Owner cancels the contract, then, the Owner agrees to pay for such item or items.

COMPLETION OF WORK – As previously stated above, all work performed by CHS Plumbing will be in compliance will local and state codes. All work will come with a full one year labor warranty from CHS Plumbing, unless stated otherwise on the invoice, and will uphold all manufacturer warranties. CHS Plumbing stands behind their customer’s and provided services.

PERMITS – In the event that a permit is required for the proposed work, the Owner agrees that there may be an additional charge for such a fee.

LEGAL PROCEDINGS – Any legal action shall be pursued in the courts of Arizona, and not withstanding any conflict of law principles, shall be governed by Arizona law. Payments not made in full will be subject to a property lien. Acceptance of this proposal is considered legal notice of a property lien.

INDEMNIFICATION – Owner shall defend, indemnify and hold CHS Plumbing harmless from any and all claims, penalties, or assessments arising from the breach of any covenant, representation or warranty herein, or from any act, omission, or misrepresentation of the Owner, and or Owner’s employees, agents or representatives, including architects, engineers, surveyors, or others engaged to perform preliminary steps necessary for CHS Plumbing to perform its Work. This indemnification shall be as broad as permissible under RSA 338-A: 2.

USE OF PICTURES – Owner agrees to allow CHS Plumbing to use any pictures of the performed work for purpose of advertising and showing others without penalty or fees from the Owner.

TESTIMONIALS – Owner agrees to allow CHS Plumbing the rights and privileges to use any and all testimonials, written or verbal, in our advertisements without penalty or fees from the Owner.
